
These Conditions of Hire apply to all skip and waste management services provided by ADS Recycling Limited (“the Company”) to its customers (“the Customer”).
1. Definitions
1.1 Equipment: Any skip, container, or waste management equipment supplied by the Company.
1.2 Services: The delivery, hire, collection, and disposal of waste as agreed with the Customer.
1.3 Site: The location where the Equipment is placed or Services are provided.
2. Hire Period
2.1 The hire period shall commence on the delivery date and continue until collection, unless otherwise agreed in writing.
2.2 Standard hire periods are 14 days, if the hire period is longer ADS Recycling must be informed upon booking of the service. If not, extended hire may incur additional charges.
3. Use of Equipment
3.1 The Equipment must only be used for storing non-hazardous waste, as agreed.
3.2 The Customer shall not:
a. Overload the skip above the fill line.
b. Move or reposition the Equipment after delivery.
c. Set fire to the contents of the skip.
d. Place hazardous or prohibited materials (e.g., asbestos, chemicals, paint, gas cylinders).
4. Delivery and Access
4.1 The Customer must provide clear, safe access to the delivery site.
4.2 Any delays caused by lack of access may result in additional charges.
4.3 The Company may refuse delivery if it deems the site unsuitable or unsafe.
5. Permits and Authorisation
5.1 If the skip is to be placed on a public highway, the Customer is responsible for obtaining the required permit from the local authority. The Company may assist, but the cost of such permits will be charged to the Customer.
5.2 The Customer shall ensure the site is compliant with all applicable legal requirements.
6. Waste Types and Duty of Care
6.1 The Customer is responsible for the classification and description of waste.
6.2 All waste must comply with the Environmental Protection Act 1990 and Duty of Care Regulations.
6.3 A Waste Transfer Note and conditions of hire must be signed and maintained.
7. Liability and Indemnity
7.1 The Equipment remains the property of the Company at all times.
7.2 The Customer is liable for any damage to the Equipment while on hire, excluding fair wear and tear.
7.3 The Customer is liable for any damage caused to property, driveway, land.
7.4 The Customer indemnifies the Company against any claims, losses, or damages arising from:
a. Misuse of Equipment;
b. Breach of these Conditions;
c. Injury or damage caused to third parties by Equipment on site.
8. Charges and Payment
8.1 Prices quoted are exclusive of VAT and any applicable permits or additional charges.
8.2 Payment terms are (payment upon booking unless you have a credit account with ourselves). Late payments may incur interest at [e.g., 2% above base rate] and administration fees.
8.3 Additional charges apply for:
a. Overloaded skips;
b. Extended hire;
c. Wasted journeys or failed collections;
d. Disposal of prohibited items;
e. Tyres, mattresses, electricals.
9. Collection and Removal
9.1 The Customer must notify the Company when the skip is ready for collection.
9.2 The Company reserves the right to remove the Equipment at any time for safety, legal compliance, or breach of these terms.
9.3 48 hours’ notice required to terminate delivery, collection, exchange.
10. Termination
10.1 The Company may terminate the agreement immediately for breach of terms or illegal use of Equipment.
10.2 On termination, the Customer shall allow prompt collection of the Equipment and pay any outstanding charges.
11. Force Majeure
11.1 The Company is not liable for delays or failure in service due to events beyond its control, including but not limited to: extreme weather, strikes, equipment failure, or legal restrictions.
12. Governing Law
12.1 These Conditions shall be governed by and construed in accordance with the laws of England and Wales.
12.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. General
· No variation to these Conditions shall be valid unless agreed in writing by the Company.
· If any clause is found unenforceable, the remaining provisions shall remain in full effect.
· These Conditions supersede all previous terms and agreements relating to the Services
